California Overtime Law

Most employees working more than eight hours in a day or more than 40 hours in a workweek must receive overtime pay. Employees often hold the misconception that all salaried employees are exempt from overtime pay. Exemptions from overtime requires a complicated analysis of each individual employee's duties. In my business law practice, I can help employers and employers determine if exemptions apply.

California Meal and Rest Break Requirements

Under California law, employees who work for more than five hours at a time are entitled to a 30 minute unpaid meal break. For every four hours worked, employees may have a ten minute paid rest break.

Employer Wage and Hour Concerns

As an employer, you are required to have a system in place that clearly defines break and meal policies. Merely having a policy is not enough; you need formal documentation stating your expectations. I can assist you in developing and documenting break policies that comply with California law.

Employers often o question whether they must pay an exempt employee overtime wages. By analyzing each employee's work day in accordance with the law, I can help you to determine if an employee falls within the exemption or fits into one of the categories of exceptions to the exemption.
